The Residential Tenancy Regulation was recently amended to explicitly confirm that assisted living accommodations are exempt from the Residential Tenancy Act. This change does not alter existing policy but provides clarity by formalizing the long-standing interpretation that assisted living, as a housing-based health facility providing hospitality and personal care services, falls outside the scope of the RTA. RTB Policy Guideline 46 has been updated accordingly.
